Your rights

Residents of California, under the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), and residents of other states with comprehensive privacy laws, such as Colorado, Connecticut, Virginia, Texas, Oregon and others, have rights over their personal information. PrequalFunnel honors the following requests from anyone in the United States, whether or not your state's law requires it:

  • Know and access. Ask what personal information we hold about you, where it came from, why we use it and who we share it with, and get a copy.
  • Correct. Ask us to fix information that is inaccurate.
  • Delete. Ask us to delete your personal information, subject to exceptions the law allows, such as records we must keep for tax purposes or to complete a transaction.
  • Portability. Get a copy of your information in a common, machine-readable format.
  • Opt out of sale, sharing and targeted advertising. We do not sell personal information, do not share it for cross-context behavioral advertising and do not use it for targeted advertising. You can still ask us to confirm this in writing.
  • Limit use of sensitive personal information. We do not use sensitive personal information for purposes that would require this right.
  • No discrimination. We will not deny you service, charge you a different price or give you a different level of service because you used these rights.

We also treat a Global Privacy Control (GPC) signal from your browser as a valid opt-out request.

How to submit a request

Email privacy@prequalfunnel.com with the subject line "Privacy request" and tell us:

  1. which right you want to use (for example, access or deletion);
  2. your name and the email address you use with us, such as your account email or the address you used on our contact form; and
  3. your state of residence, so we apply the right law.

If you have an account, you can also correct your profile details and export your contacts yourself in the app at app.prequalfunnel.com. Submitting a request is free. We may charge a reasonable fee, or decline, only where the law allows it, such as for requests that are clearly excessive or repetitive.

How we verify your identity

To protect you, we confirm who you are before we release or delete information. We match the details in your request with what we already hold, usually by replying to the email address on record and asking you to confirm. For requests involving more sensitive information or a copy of specific data, we may ask one or two further questions. We use the information you give us for verification only, and we delete it once it has served that purpose.

If we cannot verify your identity, we will tell you and explain what else we need.

Authorized agents

You may ask someone else, such as a family member, attorney or a registered authorized agent, to make a request for you. The agent must give us your signed written permission, or a valid power of attorney. Unless they hold a power of attorney, we may also ask you to confirm your identity directly and confirm that you gave the agent permission.

Timing

We acknowledge your request within 10 business days and respond within 45 days of receiving it. If we need more time and the law allows it, we will tell you within those 45 days, explain why and say when to expect a response.

Borrowers and leads we handle for our customers

PrequalFunnel powers calculators and lead forms on the websites of loan officers and mortgage brokers. When you enter your details into one of those calculators, the loan officer or broker controls that information, and we process it only on their behalf as a service provider.

  • Contact the business first. Their website's privacy notice explains how to reach them, and they can access, correct or delete your lead record.
  • If you contact us, tell us the website where you used the calculator. Where we can identify the business, we forward your request and help them carry it out. We will tell you when we have done so.
  • Information sent elsewhere. If the business forwarded your lead to its own CRM or other systems, such as HighLevel, it is responsible for deleting it there too.

If we say no

If we decline all or part of your request, we will explain why. You can appeal by replying to our decision with the word "Appeal" within 60 days. We respond to appeals within the time the law requires and explain the outcome. If you are not satisfied, you can contact your state attorney general, and California residents can contact the California Privacy Protection Agency.

Questions loan officers ask

How long will my request take?

We acknowledge requests within 10 business days and respond within 45 days. If the law allows an extension and we need it, we tell you why.

Can someone make a request for me?

Yes. An authorized agent can submit a request with your signed permission. We may still ask you to confirm your identity directly.

I filled in a mortgage calculator on a lender's website. Can you delete my information?

That information belongs to the business that runs the website. Contact them first. If you contact us, we pass your request to them where we can identify them and help them carry it out.
