Our approach

PrequalFunnel respects intellectual property and expects its customers to do the same. We respond to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This policy covers prequalfunnel.com, the app at app.prequalfunnel.com, and content that customers host through PrequalFunnel, such as logos, images and text they add to calculators, lead emails or branded portals.

Designated agent

Send copyright notices and counter-notices to our designated agent:

  • Email: legal@prequalfunnel.com
  • Subject line: "DMCA notice" or "DMCA counter-notice"
  • Postal address: available on request from the email address above.

This address is for copyright matters only. General support questions sent here will be slower to get an answer; please use support@prequalfunnel.com instead.

How to report infringement

If you believe material on our website or hosted through our service infringes a copyright you own or are authorized to act for, send a written notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you say is infringed, or, if several works are covered by one notice, a representative list.
  3. Identification of the material you say is infringing and enough information for us to find it, such as the exact URL, the calculator or widget link, or a screenshot showing where it appears.
  4. Your contact details: name, postal address, telephone number and email address.
  5. A statement that you believe in good faith that the use of the material is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

Notices missing these elements may not be valid, and we may ask you to complete them before we act.

What happens next

When we receive a valid notice, we act promptly to remove or disable access to the material. Where the material is hosted by one of our customers, we notify that customer, send them a copy of the notice, and ask them to remove it or respond. We may also ask the customer to fix the problem themselves, for example by replacing an image in their calculator theme.

Please note that we can only act on material we host or control. If the content appears on a customer's own website, outside the PrequalFunnel calculator or app, you will also need to contact that website's owner or host.

Counter-notices

If material you posted was removed or disabled and you believe this was a mistake or misidentification, you can send a counter-notice to legal@prequalfunnel.com. Under 17 U.S.C. § 512(g)(3), it must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and where it appeared before removal.
  3. A statement, under penalty of perjury, that you believe in good faith that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.

When we receive a valid counter-notice, we send a copy to the person who filed the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringing activity, we may restore the material within 10 to 14 business days after receiving the counter-notice.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of customers who are repeat infringers. We may also limit access to the service or remove content at our discretion while a matter is resolved.

False claims

Knowingly misrepresenting that material is infringing, or that it was removed by mistake, can make you liable for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f). If you are unsure whether material infringes your rights, consider speaking with an attorney before sending a notice.

Other intellectual property concerns

For trademark or other intellectual property concerns that the DMCA does not cover, email legal@prequalfunnel.com with the details and we will review them under our terms of service.
